Increase regional minimum wages for employees from July 1, 2022

Mr. Pham Binh Minh - Standing Deputy Prime Minister signed in Decree No. 38/2022/ND-CP dated June 12, 2022, stipulating the minimum wage paid for employees working under labor contracts.

This Decree stipulates the monthly minimum wage and the hourly minimum wage applied to employees working under labor contracts.

Subjects of application:

1- The employee works under a labor contract in accordance with the provisions of the Labor Code.

2- Employers according to the provisions of the Labor Code include Enterprises under the provisions of the Law on enterprise; agencies, organizations, cooperatives, households and individuals that hire employees on labor contracts.

3. Other agencies, organizations and individuals related to the implementation of the minimum wage rate specified in this Decree.

Regional minimum wages has increased by 6%

The Decree stipulates the monthly minimum wages in 4 regions as follows: Region I increased by 260,000 VND, from 4,420,000 VND/month to 4,680,000 VND/month. Region II increased by 240,000 VND, from 3,920,000 VND/month to 4,160,000 VND/month. Region III increased by 210,000 VND from 3,430,000 VND/month to 3,640,000 VND/month. Region IV increased by 180,000 VND from 3,070,000 VND/month to 3,250,000 VND/month.

The above-mentioned minimum wage increases by an average of 6% (equivalent to an increase from 180,000VND to 260,000VND) compared to the current amount.

The Decree also stipulates the hourly minimum wages in 4 regions: Region I is 22,500 VND/hour, Region II is 20,000 VND/hour, Region III is 17,500 VND/hour, Region IV is 15,600 VND/hour.

The application is determined by the location of the employer’s operation.

The Decree also clarifies that the monthly minimum wage is the lowest wage used as a basis for negotiating and paying monthly wages for employees. The wage must be paid according to the job or title of the employees, who work full-prescribed hours in a month and complete the labor norms or work as agreed, must not be lower than the monthly minimum wage.

The hourly minimum wage is the lowest wage used as a basis for negotiating and paying wages to employees who receive the hourly wage. The wage must be paid according to the job or title of the employees, who work in one hour and complete labor norms or work as agreed, and not less than the hourly minimum wage.

If the employees receive the weekly or daily wage or by product or contractual salary, the wages of these method of payment must not be lower than the minimum monthly salary or minimum hourly wage in case they are converted into monthly or hourly payment.

The Decree comes into effect from July 1, 2022.
