Many incentives and support for industrial cluster development are stipulated in Decree No. 32/2024/NĐ-CP dated March 15, 2024, by the Government.
Investment incentives for projects investing in the construction of technical infrastructure for industrial clusters and projects investing in production and business within industrial clusters.
The decree specifies investment incentives for industrial clusters, which are areas with difficult socio-economic conditions. Investment in the construction of technical infrastructure for industrial clusters is a particularly favored sector for investment.
The application of incentives for projects investing in the construction of technical infrastructure for industrial clusters and projects investing in production and business within industrial clusters shall be carried out in accordance with the laws on land, taxation, credit, and other relevant regulations. In cases where the law stipulates different levels of incentives, the highest level of incentives shall be applied.
Support for investment in the construction of technical infrastructure for industrial clusters:
The decree stipulates that the local budget (including additional revenues allocated from the central budget to local budgets) shall balance support for investment and development of technical infrastructure systems within and outside industrial clusters in the area. Priority is given to supporting the construction of environmental protection infrastructure for operational industrial clusters, supporting the construction of essential technical infrastructure for industrial clusters in areas with difficult socio-economic conditions, especially those undergoing development towards sectoral and specialized linkages, support, eco-friendly initiatives, and preservation of traditional trades, as regulated by the Laws on Public Investment and State Budget.
The state supports up to 30% of the total investment capital of projects investing in the construction of technical infrastructure for industrial clusters. The support funds are not included in the total investment amount of the project for calculating land leasing fees, infrastructure usage fees for projects within industrial clusters. The investors in the construction of technical infrastructure for industrial clusters are responsible for managing, repairing, and regularly operating the supported technical infrastructure facilities to serve the collective activities of the industrial clusters.
The provincial People's Committees shall report to the People's Councils at the same level for decision-making or make decisions within their jurisdiction and according to the legal provisions regarding supporting investment in the construction of technical infrastructure for industrial clusters in the area.
Support for industrial cluster development activities:
1. The central budget ensures funding for industrial cluster development activities carried out by the Ministry of Industry and Trade, including:
a) Investigation, construction, operation of industrial cluster databases; organization of conferences, workshops, coordination to promote investment in industrial clusters; information dissemination, printing, publication of documents, training, legal education, policies on industrial clusters;
b) Survey, evaluation, policy development, management models, experiences in industrial cluster development within and outside the country; construction, dissemination of policies and laws on industrial cluster management and development;
c) Research, development of criteria for identifying effective industrial cluster development models, environmental protection (such as specialized industrial clusters, supporting industrial clusters, ecological industrial clusters, etc.); organization of guidance, recognition of industrial cluster development models; organization of commendation, summarization, and construction of development-oriented industrial cluster reports.
2. The local budget ensures funding for industrial cluster development activities carried out by localities, including:
a) Activities for industrial cluster development as prescribed in points a and b of item 1;
b) Organization of investment promotion activities for industrial clusters; survey, assessment of organizations, individuals with relocation, investment needs in industrial clusters; establishment, expansion of industrial clusters; detailed planning for industrial cluster construction; support for administrative procedures related to industrial clusters;
c) Support for the preparation of investment projects, transportation costs, installation of machinery, equipment for enterprises, cooperatives, cooperative groups, households in craft villages, residential areas relocated into industrial clusters, craft village industrial clusters. The specific level of support is determined by the provincial People's Committees.
The decree specifies that the funding for industrial cluster development activities is a source of project funding; managed and used in accordance with the provisions of the State Budget Law and guiding documents.
